I think you are being pedantic and moving the goal posts, the claim was that you need a Microsoft account to use Windows and that is not true. You may be coerced into using one depending on the version and install method but that’s not the original claim that was made.

I can’t load those links so I’m not sure what you are referring to but broadly speaking, I don’t see the issue with using a trademark in the context of advertising that your product is compatible with another product. It’s not fundamentally different than an advertisement for an iPhone case using Apple trademarks to convey that it’s a compatible product when it’s not made by Apple. Additionally, this seems incorrect because from everything I have seen they specifically refer to the software as being in violation of their IP. I haven’t seen anything where they suggest his use of their trademarks in advertising is the issue.
He kind of does, doesn’t he? His software supports 40+ games, it’s not just Cyberpunk. There’s no Cyberpunk content in his mod, it’s just software that manipulates other software. It seems insane that people are supporting this as a legit DMCA takedown, and that the response has been to pirate his software like that is somehow now justified by him allegedly violating CDPR IP. I don’t get it at all. If he was distributing a modified version of their game that would be one thing but it’s software that allows users to modify a variety of different games they have a license for, which is obviously something else entirely.

Those two statements do not mean the exact same thing. Trump being less shitty than Hitler doesn’t make Trump good, you are definitely misunderstanding the saying. It’s about trying to achieve goals, and the importance of knowing when you’ve maximized the achievement possible without ruining your chances of achieving the goal by pressing further. It doesn’t mean “I can imagine something worse, therefore this terrible choice I do not want is now alright with me”.
I don’t understand your Hitler example, it does not seem to be an example that fits the saying. How is Trump good to Hitler’s perfect? Or is it the reverse? Either way doesn’t make sense to me. Normally that saying is used in a context where someone is potentially getting some of what they actually want, because getting all of what they want is not feasible, and continuing to pursue all of what they want risks them not getting anything they want. In your example you seem to be using it like it means you get a choice of either a negative outcome or a worse negative outcome, which is not correct.

Another one I saw mentioned by the NYT is his missing tattoo. Epstein apparently testified in a deposition that he had a tattoo of barbed wire on his upper arm, except it is not visible in pictures of his corpse. Not sure what to make of that but it’s odd and hasn’t been explained yet.
